Makes the reasonable accommodations provisions in state fair housing law consistent with federal Fair Housing Act case law and interpretations.

RELATING TO HOMELESS PROGRAMS.

Requires department of human services, in consultation with the counties and any interested private homeless assistance programs, to develop temporary nighttime parking lots to provide safe overnight locations for homeless individuals who would otherwise sleep in their motor vehicles on public or private roads or property.

Restores funding for positions for the homeless programs office of the department of human services.

RELATING TO PUBLIC HOUSING.

Authorizes the Hawaii public housing authority to assess a fee to all units for community facility maintenance.  Requires minimum rent schedule for housing projects and annual Consumer Price Index adjustments of minimum rent.  Requires reimbursement for the cost of repairs to a unit.

RELATING TO INTOXICATING LIQUORS.

Prohibits open alcoholic beverage containers on any common area of a public housing project.

RELATING TO PUBLIC HOUSING.

Prohibits smoking in and around public housing projects or state low-income housing projects under the jurisdiction of the Hawaii public housing authority.

RELATING TO PUBLIC HOUSING.

Requires the Hawaii public housing authority to establish a minimum rent schedule.  Requires a minimum monthly rent of $250 for state low-income housing units and annual adjustment of minimum rent based upon the national average wage index.  Prohibits preferences for tenant selection.

Status

RELATING TO HOUSING POLICY.

Extends the lapse date of funds appropriated from the emergency and budget reserve fund for the housing first pilot program to December 31, 2011.  The legislature appropriated the funds for the program pursuant to Act 191, Session Laws of Hawaii 2010.

Status

RELATING TO PLANNED COMMUNITY ASSOCIATIONS.

Prohibits planned community associations from disallowing a member's or a member's bona fide tenant's house-mounted display of the United States and State of Hawaii flags provided the display meets size restrictions.  Requires the display to be at the front of the dwelling and in accordance with state and federal law.

RELATING TO PLANNED COMMUNITY ASSOCIATIONS.

Provides that planned community associations may not prohibit members from displaying the United States or Hawaii flag.  Permits reasonable time, place, and manner restrictions on flag displays but prohibits assessment of a fee to approve the display.

RELATING TO MORTGAGE FORECLOSURES.

Requires remainder of proceeds following a foreclosure sale to be paid to the previous mortgagor of the foreclosed property or to the unclaimed property trust fund.

Status

RELATING TO HOUSING.

Requires review of all persons or businesses who qualified for a tax exemption for affordable housing projects certified by the Hawaii housing finance and development corporation, with a second review by the department of taxation.  Requires an annual report to the legislature.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

·     The Committee the comments are directed to;

·     The date and time of the hearing;

·     Measure number; and

·     The number of copies the Committee is requesting. 

 

While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
