RELATING TO PUBLIC HOUSING.

Requires all visitors to public housing projects to receive a visitor pass from authorities of the public housing project.  Establishes the non-possession of a visitor pass as prima facie evidence of criminal trespass in the first degree.

RELATING TO PUBLIC HOUSING.

Eliminates most procedural requirements preliminary to an eviction hearing for tenants in public housing.  Requires evictions to be conducted by hearings officers appointed by the Hawaii public housing authority.

Requires mandatory reporting for criminal property damage, drug dealing or drug use, and terroristic threatening.  Requires the housing authority to evict tenants who violate rules.

Allows the public housing authority to seek reimbursement from the tenant responsible for damages to the community facility area and any unit.  Deletes references to a prospective tenant's need with respect to tenant selection procedures.

RELATING TO MORTGAGE FORECLOSURES.

Requires remainder of proceeds following a foreclosure sale to be paid to the previous mortgagor of the foreclosed property or to the unclaimed property trust fund.

RELATING TO MORTGAGE FORECLOSURES.

Requires foreclosing lenders to notify certain mortgagors about credit counseling no later than 30 days prior to a regular non-judicial foreclosure.  Allows certain mortgagors to forestall regular non-judicial foreclosure proceedings by requesting copies of the promissory note and mortgage document.

Status

RELATING TO CONDOMINIUM DISPUTE RESOLUTION.

Requires certain condominium-related disputes involving an owner and the association to be submitted to mediation.  Requires the real estate commission of the State to submit a summary to the legislature detailing which programs were directed at the development of expeditious and inexpensive condominium-related disputes.  Repeals section 514B-161, HRS.  Authorizes funds from the condominium education trust fund to be used for mediation services.

Permits members of condominium associations to make electronic recordings of association meetings for personal use.

RELATING TO CONDOMINIUMS.

Allows a condominium board, in good faith, and without legal responsibility or liability, to employ a nurse to provide services to an elderly or disabled unit resident which may allow the resident to live safely and independently and avoid disruption to the condominium community.

RELATING TO PLANNED COMMUNITY ASSOCIATIONS.

Prohibits the board of directors on home association boards from harassing or intimidating its members.  Holds board members jointly and severally liable for certain violations under chapter 421J, HRS.  Requires reasonable notice of board actions.

RELATING TO HOUSING.

Requires review of all persons or businesses who qualified for a tax exemption for affordable housing projects certified by the Hawaii housing finance and development corporation, with a second review by the department of taxation.  Requires an annual report to the legislature.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
