RELATING TO TOBACCO PRODUCTS. Imposes an excise tax on tobacco products other than cigarettes, little cigars, and large cigars. Imposes an excise tax on bulk and small quantity purchases of tobacco products and cigars. Requires a portion of the tax to be expended for tobacco prevention programs and services. Effective 7/1/2050.

RELATING TO TAXATION. Repeals Act 155, Session Laws of Hawaii 2010, which requires all businesses with excise tax exemptions to register to do business in Hawaii, file their tax returns in a timely manner, and expressly claim their entitlement and creates a personal trust liability for businesses that use the general excise tax as the basis for increasing their prices, and ensures that those funds are paid to the State for the benefit of consumers and businesses. Effective 7/1/2050.

RELATING TO THE EMERGENCY AND BUDGET RESERVE FUND. Makes emergency appropriations from the emergency and budget reserve fund and makes technical corrections to Act 191, Session Laws of Hawaii 2010, to permit the awarding of grants to specified organizations. Extends the lapse date of Act 191's appropriations from 6/30/11 to 6/30/12.

RELATING TO TAXATION. Prohibits penalties for wilful failure to collect and pay over taxes, substantial understatements or misstatements, and erroneous claims for refund or credit from being added to tax underpayments on which certain other penalties are already imposed.

RELATING TO CORRECTIONS. Specifies criteria that must be considered in deciding whether to transfer inmates between correctional facilities located in Hawaii and to transfer inmates from Hawaii to mainland facilities. Prohibits transfer of inmates to mainland with 12 months or less to serve before being eligible to be paroled. Also prohibits transfer of inmates within Hawaii and to the mainland who are diagnosed with serious medical or mental conditions. Effective July 1, 2011.

Requires the University of Hawaii Board of Regents to periodically review the priority guidelines for quality education and recommend amendments to the Legislature, develop a functional plan that includes strategic goals, outcomes, and performance indicators, and report biennially to the Legislature.

RELATING TO EDUCATION. Requires multi-track public schools to have a school year of at least one hundred seventy-one days or ninety per cent of the minimum days required of other non-charter public schools. Requires the Department of Education to submit to the legislature a plan to implement a school year for multi-track schools beginning with the 2015-2016 school year of ninety per cent of the minimum instructional days required of other non-charter public schools. Effective July 1, 2050.

Appropriates funds from the Hawaii hurricane relief fund to the general fund for the purpose of balancing the state budget in fiscal year 2011-2012; requires reimbursement to the Hawaii hurricane relief fund beginning in fiscal year 2013-2014. Effective 7/1/2050.

RELATING TO THE PUBLIC UTILITIES COMMISSION. Directs the Public Utilities Commission to accept filings and applications electronically no later than January 1, 2012. Allows use of automatic rate adjustment clause to meet revenue requirement when electric utility company and its electric utility subsidiaries aggregate their renewable portfolios to meet renewable portfolio standards.
