RELATING TO ROADWAY MATERIALS. Clarifies that state agencies may purchase roadway materials with a minimum recycled glass content. Allows use of minimum glass of ten per cent crushed glass aggregate in all basecourse and subbase.

RELATING TO THE OFFICE OF ENVIRONMENTAL QUALITY CONTROL. Establishes filing fees to help fund operations of the Office of Environmental Quality Control. Creates special fund. Effective July 1, 2050. Provides for a lag time for the collection of fees.

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS. Extends the sunset date of Act 87, Session Laws of Hawaii 2009, from July 1, 2011, to July 1, 2015; Act 87 exempts from the environmental impact statement law under chapter 343, Hawaii Revised Statutes, certain primary actions not subject to discretionary consent and involving ancillary secondary actions limited to infrastructure work in public rights-of-way or highways.

RELATING TO BIOFUELS. Modifies the renewable energy facility siting process to include biofuel production facilities and distribution infrastructure with capacity to produce or distribute one hundred thousand gallons or more of biofuel annually.

RELATING TO SOLID WASTE. Applies the solid waste disposal surcharge to waste that is deposited in landfills, incinerators, or waste-to-energy facilities, whether the waste is disposed of in-state or transferred out-of-state. Effective 07/01/2050.

RELATING TO BIOFUEL. Requires diesel fuel sold in the State for use in motor vehicles to contain five per cent biodiesel that is produced in the State from locally-sourced products meeting certain certification standards.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
