RELATING TO UNEMPLOYMENT INSURANCE BENEFITS. Authorizes an individual that is attached to a regular employer who is not offering work to receive unemployment insurance benefits even if the individual voluntarily or involuntarily separates from part-time employment, with or without good cause. Effective July 1, 2011.

RELATING TO EMPLOYMENT SECURITY LAW. Appropriates 2009 special administrative transfer for payment of Unemployment Insurance administration expenses.

RELATING TO FEDERAL TAX QUALIFICATION REQUIREMENTS FOR THE EMPLOYEES' RETIREMENT SYSTEM. Adopts language, regarding death benefits for Employees' Retirement System member on qualified military service, required to maintain the tax-qualified status of the Employees' Retirement System and adopts provisions, for the commencement of benefits, required to maintain the tax qualified status of the Employees' Retirement System.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Increases the members on the ERS board of trustees from eight to ten. Establishes county representation on the ERS board of directors.

RELATING TO EMPLOYMENT SECURITY. Enacts the optional total unemployment rate trigger. Appropriates funds for an automated extended benefit claims system. Effective January 1, 2012.

RELATING TO EMPLOYMENT PRACTICES. Makes it unlawful for any employer or labor organization to suspend, discharge, or discriminate against an employee solely because the employee uses accrued and available sick leave. Allows an employer or labor organization to require written verification by a physician that the employee was ill. Effective January 7, 2059.

RELATING TO PUBLIC WORK PROJECTS. Clarifies that up to six single violations of the prevailing wage law refers to each separate project where the Department of Labor and Industrial Relations finds a contractor in violation. Allows a violator to use an affirmative defense at appeal that the violation occurred unintentionally.

RELATING TO COUNTIES. Authorizes the counties to appoint and remove their respective liquor administrators unless otherwise prescribed by their respective county charter.

RELATING TO THE EMPLOYER-UNION HEALTH BENEFITS TRUST FUND. Requires one of the members of the EUTF board of trustees to be appointed by agreement of the mayors of the four counties and approved by the Hawaii State Association of Counties. Permits the Governor to fill the vacancy should it not be filled within sixty days.

RELATING TO HEALTH INSURANCE. Limits the Hawaii Employer-Union Health Benefits Trust Fund board to contract for health benefits plans only with carriers that provide or administer prescription drug coverage together with medical benefits.

RELATING TO REPACKAGED DRUGS AND COMPOUND MEDICATIONS. Establishes price caps for the Hawaii workers' compensation insurance system for drugs, including repackaged drugs and compound medications. Effective July 1, 2050.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
