RELATING TO PUBLIC ACCESS.

Clarifies that where public access is required as a condition of a subdivision, either the county must accept dedication of and maintain the access or identify an entity to own and maintain the access.  Authorizes county to require subdivider to provide establishment of a stewardship fund for maintenance purposes.

RELATING TO TAXATION.

Imposes conveyance tax on the transfer of a controlling interest of an entity with an interest in real property.  Imposes the conveyance tax on certain transfers of real property at the lowest tax rate.

RELATING TO PUBLIC LANDS.

Authorizes Board of Land and Natural Resources to extend leases of public lands for commercial, hotel, resort, or industrial use upon approval of a proposed development agreement to make substantial improvements to the premises.  Sunsets December 31, 2015.

Requires the Department of Land and Natural Resources to consider the sale or exchange of Sand Island parcels to leaseholders.  Requires a report of findings and recommendation to the Legislature.  Effective January 1, 3000.

Provides state lease preferences for the reconstruction, restoration, repair, or use of Hawaiian fishponds.

RELATING TO PUBLIC LANDS.

Allows the Board of Land and Natural Resources to extend or modify the fixed rental period of certain leases; provided that the aggregate of the initial term and any extension granted does not exceed 65 years.

·     The Committee the comments are directed to;

·     The date and time of the hearing;

·     Measure number; and

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
