RELATING TO TAXATION. Prohibits the ethanol facility tax credit from being claimed prior to January 1, 2014.

RELATING TO THE PHOTO ENFORCEMENT REVOLVING FUND. Transfers all moneys in the photo enforcement revolving fund to the general fund.

RELATING TO THE DEPARTMENT OF BUSINESS, ECONOMIC DEVELOPMENT, AND TOURISM. Establishes the department of business, economic development, and tourism operation special fund to support operations. Imposes a temporary surcharge on certain fees charged by certain departments for deposit into fund. Effective July 1, 2112.

RELATING TO THE GENERAL EXCISE TAX. Creates a nexus standard for taxing out-of-state businesses on their business activities in Hawaii. Amends the definition of engaging in business to include local affiliate agreements. Allows out-of-state businesses to file information regarding sales to residents of the State instead of collecting GET. Effective 7/1/2112.

RELATING TO THE HAWAII HURRICANE RELIEF FUND. Appropriates funds from the Hawaii Hurricane Relief Fund into the State general fund to balance the State budget.

RELATING TO TAXATION. Repeals requirement that $2,000,000 of tax revenues from banks and other financial corporations be deposited into the compliance resolution fund. Authorizes the commissioner of financial institutions to expedite the imposition or increase of fees on banks and other financial corporations. Effective 07/01/11 and sunsets on 12/31/15.

RELATING TO FINANCE. Requires the Director of Finance to transfer funds from the Compliance Resolution Fund to fund all interest payments on General Obligation bonds issued on behalf of the Department of Commerce and Consumer Affairs and to annually collect funds from the Compliance Resolution Fund to pay the interest payments on the General Obligation bonds beginning on July 1, 2011.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
