RELATING TO PROCUREMENT. Provides procurement authority to the director of a semi-autonomous county public transit agency. Effective July 1, 2112.

RELATING TO TELECOMMUNICATIONS. Exempts broadband infrastructure improvements from state or county permitting requirements for five years. Exempts telecommunications companies from replacing existing utility poles when installing new or improving existing telecommunications cables. Effective July 1, 2112.

RELATING TO PROCUREMENT. Establishes the use of the design-build process where the cost of preparing proposals is high relative to the size, estimated price, and complexity of the project. Authorizes a two-part process where prequalified applicants will be short-listed to submit design proposals. The short list shall be publically disclosed, or unsuccessful offerors will receive stipends. Effective July 1, 2112.

RELATING TO LIMITED LIABILITY COMPANIES. Allows a limited liability company to be designated as an "ingenuity company" by the Director of Commerce and Consumer Affairs. Requires an ingenuity company to use the right to exclude, conferred by a patent in which the company has an interest, to create job opportunities, strengthen labor, and enhance environmental protections. Effective July 1, 2112.

RELATING TO TELEVISION. Requires the auditor to analyze the allocation of cable operator franchise fees. Requires a performance review or audit of Olelo Community Television. Appropriation.

RELATING TO THE AUDITOR. Grants explicit authority to the Auditor to inspect the documents and financial affairs of the Department of Taxation. Requires the Auditor to implement internal policies to protect confidentiality of private personal information contained in tax returns. Provides penalty provisions applicable to the Auditor or Auditor's agent for disclosure of tax information.

RELATING TO EMPLOYMENT OF ATTORNEYS. Allows the state ethics commission to employ or retain its own attorneys.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

FAX: For comments less than 5 pages in length, transmit to 586-6001 (Oahu) or 1-800-535-3859 (for Neighbor Islanders without a computer to submit testimony through e-mail or the Web); or
WEB: For comments less than 4MB in size, transmit from the Web page at http://www.capitol.hawaii.gov/emailtestimony.
Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
