RELATING TO GOVERNMENT RECORDS. Provides that for purposes of the Freedom of Information Law, there is no significant privacy interest in government records containing information on a license applicant's requisite experience, trade examination results, and bonding.

RELATING TO TOBACCO. Makes it unlawful for minors, defined as persons under age eighteen, to possess or use tobacco products. Exempts minors when lawfully delivering tobacco products under the direction of an employer or participating in a law enforcement activity. Amends consequences for a minor for subsequent offenses.

RELATING TO THE DEPARTMENT OF BUSINESS, ECONOMIC DEVELOPMENT, AND TOURISM. Establishes the department of business, economic development, and tourism operation special fund to support operations. Imposes a temporary surcharge on certain fees charged by certain departments for deposit into fund. Requires deposit of $2,000,000 annually from the compliance resolution fund into the special fund.

RELATING TO BUSINESS. Establishes the small business hardship loan program to direct one-time loans to small businesses that are experiencing economic hardship. Establishes the small business hardship loan revolving fund.

RELATING TO PAYMENT FOR GOODS AND SERVICES. Requires payments by governments for goods and services to be made within fifteen days of receipt of the statement or satisfactory delivery of the goods or performance of the services; if mitigating circumstances, interest begins on sixteenth day; payment required no later than forty-five days from receipt of the statement or satisfactory delivery of the goods or performance of the services.

RELATING TO TAXATION. Requires the department of taxation to establish a system to allow taxpayers to file all tax returns, applications, reports, and other documents electronically; provided that there is no additional cost to the taxpayer for the electronic filing; reestablishes the last of the month as the deadline for filing and payment of general excise taxes.

RELATING TO THE INCOME TAX. Reduces the maximum income tax withholding amount allowed under state law.

RELATING TO LIQUOR COMMISSIONS. Requires county liquor commissions to adopt or amend rules regarding conduct of patrons and to define the term "dancing."

RELATING TO LIQUOR TAX LAW. Reduces the gallonage tax on the first 60,000 barrels of beer brewed or produced during a taxable year by a small brewery or brewpub in the State to $0.23 per gallon of beer.

RELATING TO TELECOMMUTING. Provides an income tax credit to employers who allow their employees to telecommute. Prevents counties from limiting the practice of telecommuting unless the business activity generates excessive noise, dust, debris, or traffic in the area where the employee is engaged in telecommuting.

RELATING TO INSURANCE. Clarifies the laws relating to the interpretation of commercial liability insurance policies affecting construction professionals.

RELATING TO REAL PROPERTY. Mandates conditions applicable to commercial and industrial leases where the lessor owns fifty thousand square feet or more of commercial or industrial leasehold property in the State.

RELATING TO GROUND LEASES. Requires lessors who do not extend a ground lease to offer to sell the leased fee interest in the land to the lessee who requests the extension.

RELATING TO TAX CREDITS. Amends the motion picture, digital media, and film production tax credit to provide a designated income tax credit for certain qualifying counties. Removes tax credit caps. Provides an additional bonus for qualifying spending related to computer aided special or visual effects and animation. Establishes a non-refundable tax credit with a carry forward period of up to ten years to encourage film production development in certain qualified counties. Allows for a certain exemption from the transient accommodation tax for stays exceeding thirty days. Permits certain production tax credits to be assigned.

RELATING TO LIMITED LIABILITY COMPANIES. Allows a limited liability company to be designated as an "ingenuity company" by the Director of Commerce and Consumer Affairs. Requires an ingenuity company to use the right to exclude, conferred by a patent in which the company has an interest, to create job opportunities, strengthen labor, and enhance environmental protections.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.
