RELATING TO RENEWABLE ENERGY.

Increases the net metering system size cap to two megawatts.  Ensures that net metering contracts cannot be canceled with the introduction of new distributed generation energy procurement programs.  Eliminates the overall net energy metering program cap based on share of peak utility load.

Exempts third-party customer-generated solar energy facilities and equipment from the definition of public utility; makes nonsubstantive technical amendments to the definition of public utility.

RELATING TO ENERGY.

Requires the public utilities commission to adopt rules and issue orders relating to intra-governmental wheeling and inter-governmental wheeling that enable renewable energy producers operating on public lands to sell electricity directly to governmental entities located on the same island.  Authorizes public utilities to charge a transmission and distribution fee for both intra-governmental wheeling and inter-governmental wheeling.

RELATING TO RENEWABLE PORTFOLIO STANDARDS.

Amends definition of "renewable electrical energy" to include, beginning 1/1/15, customer-sited, grid-connected renewable energy generation.

RELATING TO FOSSIL FUELS.

Restricts any new construction of or expansion of existing fossil-fueled, electricity-generating facilities unless the electric utility company can demonstrate compliance with the renewable energy portfolio standards; exempts any retrofit or replacement for the purposes of improved efficiency or to lower greenhouse gas emissions; provides exemption if an emergency is declared.

Ensures that agencies that enter into energy performance contracts shall continue to receive budget appropriations for energy expenditures in an amount that shall not fall below the pre-performance contract budget.

RELATING TO SEAWATER AIR CONDITIONING.

Allows the sale of cooling from seawater air conditioning district cooling systems (SWAC) to qualify for state enterprise zone benefits.  Establishes that contractors working on SWAC shall not be exempt from the general excise tax.

RELATING TO BIOFUELS.

Modifies the renewable energy facility siting process to include biofuel production facilities and distribution infrastructure with capacity to produce or distribute one hundred thousand gallons or more of biofuel annually.

·         In person:  1 copy of their testimony to the committee clerk, Room 201, State Capitol.

 

·         By fax:  Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing.  When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.

 

Please note:  If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally.  A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
