RELATING TO MORTGAGE LENDERS. Requires financial institutions otherwise exempt from regulation as mortgage servicers or licensing by the commissioner of financial institutions to register with the commissioner of financial institutions and be subject to the commissioner's regulatory authority.

RELATING TO BROKER PRICE OPINIONS. Permits a licensed real estate broker or real estate sales person to prepare broker price options for use in real estate transactions where an appraisal is not required by law or otherwise.

RELATING TO ESCROW DEPOSITORIES. Requires every person subject to section 454F-1.5 to include the person's unique identifier on every document submitted to an escrow depository in a real estate transaction; requires escrow depositories to report invalid unique identifiers to the commissioner of financial institutions.

RELATING TO REAL ESTATE APPRAISERS. Expands the scope of the current law to include the regulation of real estate appraisal management companies in order to comply with the federal Financial Institutions Reform, Recovery, and Enforcement Act of 1989 ("FIRREA") and the federal rules adopted thereunder.

RELATING TO HAWAII REVISED STATUTES SECTION 514B-153(E). Exempts a condominium association from maintaining records for individual time share owners, when the project or units in the condominium project as subject to a time share plan under chapter 514E, Hawaii Revised Statutes, unless the individual time share owner requests that the condominium association maintain the owner's name and address in the condominium association's records.

RELATING TO CONDOMINIUMS. Permits members of condominium associations to make electronic recordings of association meetings for personal use.

RELATING TO CONDOMINIUMS. Requires condominium projects or associations of apartment owners to submit with their biennial registrations with the real estate commission data on the number of leasehold units in a project or association and their appraised value.

RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE. Specifies that a landlord and tenant may agree that duly apportioned rent shall be due at intervals more frequent than monthly.

RELATING TO RESIDENTIAL REAL PROPERTY. Requires that condominium property managers, associations of apartment owners, and planned community associations make association documents available to owners and their respective agents under reasonable terms and for reasonable costs.

· In person: 1 copy of their testimony to the committee clerk, Room 229, State Capitol.
· By fax: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
Please note: If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
