Removes long-term care insurance from the definition of "accident and health or sickness insurance" and related terms within the insurance code; removes reference to insurance fraud statute.

RELATING TO INSURANCE RECORDS.

Exempts insurance producers from keeping records of insurance transactions for motor vehicle and homeowners' insurance contracts where records are customarily maintained in the offices of the insurer.

Allows an insurer to cancel or refuse to renew a motor vehicle policy where the policy is transferred to a subsidiary or affiliate of the insurer, and the premium rate is reduced by the transfer.

Updates the Insurance Code and related provisions to adopt the revisions to the National Association of Insurance Commissioners model laws and regulations for risk-based capital trend test for property and casualty insurers which is required for National Association of Insurance Commissioners accreditation.

RELATING TO MORTGAGE LOAN ORIGINATORS.

Amends the secure and fair enforcement for mortgage licensing act to require all mortgage loan originators to work under the sponsorship of a registered entity; specifies standards for processing denied, abandoned, and withdrawn applications; specifies additional prohibited practices and prohibited loan terms; specifies duties and qualifications for supervisory staff of sponsoring entities; restricts fees payable to a licensee; clarifies confidentiality provisions for applications; establishes licensing fees for sponsoring entities; makes conforming amendments.  (SD1)

·         By Web: Testimony may be submitted online if less than 4MB in size, at http://www.capitol.hawaii.gov/emailtestimony.

 

·         In person:  1 copy of their testimony to the committee clerk, Room 229, State Capitol.

 

·         By fax:  Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing.  When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.

 

Please note:  If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally.  A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
