RELATING TO INSURANCE. Clarifies the laws relating to the interpretation of commercial liability insurance policies affecting construction professionals.

RELATING TO FORECLOSURES. Authorizes a planned community association or a condominium association to pursue nonjudicial foreclosure on units within the association for outstanding liens.

RELATING TO PLANNED COMMUNITY ASSOCIATIONS. Creates notice requirements for meetings of a planned community association or its board of directors.

RELATING TO CONDOMINIUMS. Repeals the sunset date on the condominium dispute resolution pilot project ("condo court").

RELATING TO UNIFORM REAL PROPERTY TRANSFER ON DEATH. Adopts Uniform Real Property Transfer on Death Act. Allows owner of real property to designate beneficiaries to receive real property upon death of owner without requirements of probate or formalities of wills. Effective July 1, 2011.

RELATING TO CONTRACTORS. Requires applicants and holders of a contractor license to be subject to a criminal history record check conducted by the contractors licensing board pursuant to rules adopted by the board.

RELATING TO CHAPTER 480, HAWAII REVISED STATUTES. Clarifies antitrust law to reconfirm the right of government entities to bring an action for damages notwithstanding their status as indirect purchasers.

RELATING TO FAIR HOUSING EXEMPTIONS. Makes exemptions from state fair housing laws consistent with similar exemptions found in the federal Fair Housing Act and makes protected groups consistent throughout Chapter 515, Hawaii Revised Statutes.

RELATING TO FAIR HOUSING REASONABLE ACCOMMODATIONS. Makes the reasonable accommodations provisions in state fair housing law consistent with federal Fair Housing Act case law and interpretations.

· By Web: Testimony may be submitted online if less than 4MB in size, at http://www.capitol.hawaii.gov/emailtestimony.
· In person: 1 copy of their testimony to the committee clerk, Room 230, State Capitol.
· By fax: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
Please note: If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
