RELATING TO THE PUBLIC UTILITIES COMMISSION. Establishes notice and fact-finding requirements for the issuance of certificates of public convenience and necessity for water carriers; expands the composition of the PUC to five members with a representative from each county plus one at-large member; creates specialized subject-matter panels within the PUC; mandates the hiring of sufficient staff; creates the position of executive officer; requires electronic posting of information in connection with applications for certificates of public convenience and necessity; bars interim or temporary orders for certificates of public convenience and necessity except in state-declared emergencies. RELATING TO THE PUBLIC UTILITIES COMMISSION. Directs the public utilities commission to accept filings and applications electronically no later than January 1, 2012. (SD1)

RELATING TO CABLE TELEVISION SYSTEMS. Allows the director of commerce and consumer affairs to designate an access organization to oversee public, educational, and governmental channels on cable television. Effective 7/1/2050. (SD1)

RELATING TO THE HAWAII HURRICANE RELIEF FUND. Appropriates funds from the Hawaii hurricane relief fund to the general fund for the purpose of balancing the state budget in fiscal year 2011-2012; requires reimbursement to the Hawaii hurricane relief fund beginning in fiscal year 2013-2014. RELATING TO ESCROW DEPOSITORIES. Requires every person subject to section 454F-1.5 to include the person's unique identifier on every residential mortgage loan application submitted to an escrow depository in a real estate transaction; requires escrow depositories to report invalid unique identifiers to the commissioner of financial institutions. Effective 7/1/2050. (SD1)

RELATING TO BROKER PRICE OPINIONS. Permits a licensed real estate broker or real estate sales person to prepare broker price opinions for use in real estate transactions where an appraisal is not required by law or otherwise; clarifies that recovery from the real estate recovery fund is not available for complaints regarding broker price opinions. RELATING TO NONPROFIT CORPORATIONS. Amends the Hawaii nonprofit corporations act to permit member actions by ballot and electronic voting, use of electronic notice, and conduct of meeting by teleconference. (SD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
