RELATING TO RANGE LAND LIABILITY. Limits range land owners' liability in cases of trespass or granted recreational use.

MAKING AN APPROPRIATION FOR INVESTIGATION AND MITIGATION OF DAMAGE DONE BY THE COFFEE BERRY BORER. Appropriates funds in FY 2011-2012 and FY 2012-2013 to mitigate the effects of the coffee berry borer in the Kona region on the island of Hawaii. Requires DOA to submit a progress report to the legislature.

RELATING TO THE CACAO INDUSTRY. Adopts some of the recommendations of the "Report to Expedite the Production and Delivery of Hawaii Cacao to the Marketplace".

RELATING TO PLANT THEFT. Requires a person who steals agricultural products or commodities to pay the property owner the value of the stolen product and the cost of replanting.

RELATING TO LANDOWNER LIABILITY. Establishes a criminal trespass on agricultural lands enforcement fund; provides that owners of agricultural land or range land have no duty of care to trespassers; establishes rebuttable presumption of no liability; permits trespasser to overcome presumption by preponderance of evidence that owner was grossly negligent or intentionally injured the trespasser; authorized fines of up to $10,000 for the offense of criminal trespass on agricultural lands.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
