RELATING TO AGRICULTURE. Requires an agricultural subdivision or agricultural condominium in an agricultural district to be approved by the relevant county council by ordinance.

RELATING TO AGRICULTURAL DEVELOPMENT. Expands the authorized uses of the agricultural development and food security special fund to include the improvement and investigative studies of dams and reservoirs. Authorizes director of finance to issue general obligation bonds for the special fund.

RELATING TO BUILDING PERMITS. Exempts from county building permit requirements construction of low risk nonresidential and aquacultural structures, under certain conditions.

RELATING TO LANDOWNER LIABILITY. Establishes that an owner or possessor of private land that is closed to the public owes no duty of care to a person who commits the offense of criminal trespass on the owner's or occupier's land, except where death or injury to the trespasser may result from the owner's or occupier's gross negligence or wilful conduct; clarifies that provisions related to criminal trespass in the second degree apply to agricultural lands that are fallow.

RELATING TO AQUACULTURE. Increases aquaculture leases from 35 to 45 years and allows a maximum term of 65 years for ventures in good standing for 10 years or more. Provides lessees in good standing the right of first refusal. Allows for supportive aquaculture activities.

RELATING TO WATER. Allows for the preparation of a water development study and establishes the water development study special fund. Effective July 1, 2011.

RELATING TO DROUGHT MITIGATION. Appropriates funds to the counties for drought mitigation purposes. Requires the counties to report to the legislature on the status of drought mitigation projects.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
