SENATE CONCURRENT
RESOLUTION
REQUESTING THE BOARD OF EDUCATION TO REVIEW ITS BY-LAWS AND POLICIES AND APPLICABLE ADMINISTRATIVE RULES AND STATUTES TO IMPROVE THE EFFECTIVENESS OF THE EDUCATIONAL DELIVERY SYSTEM.
WHEREAS, the public school system in Hawaii is the largest department in state government; and
WHEREAS, the Board of Education and the Department of Education have volumes of administrative rules, regulations, by‑laws, and statutes to which they must adhere; and
WHEREAS, as the result of a constitutional amendment adopted in the 2010 general election, the Board of Education is required to transform from an elected board to an appointed board, with the appointments being made by the Governor; and
WHEREAS, this change in educational governance may provide the Board of Education with a unique opportunity to review the Board's by-laws and policies, as well as applicable sections of the Hawaii Revised Statutes and Hawaii Administrative Rules, to determine if amending or reducing regulatory constraints and requirements might assist the Board, the Department of Education, and school administrators in creating a more effective educational delivery system; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the House of Representatives concurring, that the Board of Education is requested to undertake a two-year review of its by-laws and policies, as well as applicable sections of the Hawaii Revised Statutes and Hawaii Administrative Rules; and
BE IT FURTHER RESOLVED that after one year of review, the Board of Education may make any changes to its by-laws and policies that would assist the Board, the Department of Education, and school administrators to create a more effective educational delivery system; and
BE IT FURTHER RESOLVED that the Board of Education submit a report of its findings, including any changes made to its by‑laws and policies, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2012; and
BE IT FURTHER RESOLVED that the Board of Education submit a report to the Legislature, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2013; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Education and the Superintendent of Education.
