A BILL FOR AN ACT

 

 

relating to dislocated workers.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 394B-9, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  An employer of a covered establishment that is  actively seeking a buyer for a sale, transfer, or merger or engaged in a bankruptcy proceeding shall [not] be required to provide the notice required under subsection (a) [until] regardless of whether or not the employer has entered into a binding agreement for the sale, transfer, or merger of the covered establishment that results in a divestiture[.] or has concluded a bankruptcy proceeding."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
