A BILL FOR AN ACT

 

 

relating to the public utilities commission.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Notwithstanding the language of section (G)(2) of Schedule FIT Tier 1 and Tier 2 of the public utilities commission docket No. 2008-0273, no electric utility shall be excused from paying for power at the rates set forth in section (G)(2) of Schedule FIT Tier 1 and Tier 2 on the basis that a copy of the seller's tax form was not received by the company prior to the commercial operation date when it is not possible to complete the form prior to the commercial operation date.

     For purposes of this Act:

"Company" means the public utility purchasing power from the seller, subject to the terms of Schedule FIT Tier 1 and Tier 2.

     "Commercial operation date" means the date the seller notifies the company that the energy-generating project is operating and able to produce and deliver energy to the company pursuant to the terms of Schedule FIT Tier 1 and Tier 2.

     "Seller" means the seller of power.

     SECTION 2.  This Act shall take effect upon its approval; provided that this Act shall be repealed on the earlier of June 30, 2015, or when the public utilities commission issues a decision and order that supersedes section (G)(2) of Schedule FIT Tier 1 and Tier 2 of the public utilities commission docket No. 2008-0273.
