HOUSE CONCURRENT
RESOLUTION
REQUESTING THE AUDITOR TO CONDUCT A SUNRISE REVIEW of the rental property manager PROFESSION.
WHEREAS, H.B. No. (2011) proposes to regulate the rental property manager occupation, which is presently unregulated; and
WHEREAS, Hawaii has an increasing number of residential properties that are owned by persons that reside in and out of the State and these properties are used by their owners as rental properties; and
WHEREAS, this increase in the number of rental properties in Hawaii has led to an increase in the number of individuals and businesses that manage these properties for their owners, including collecting rent from tenants; and
WHEREAS, although many property managers hold a real estate license, many others that manage rental properties for their owners do not have a real estate license; and
WHEREAS, without a regulatory requirement for rental property managers that manage rental property for others, there is no assurance that rental property managers have an adequate understanding of Hawaii's laws relating to landlord-tenant rights, rent collection, and preservation of rental deposits; and
WHEREAS, section 26H-6, Hawaii Revised Statutes, requires the Auditor to review proposals to regulate heretofore unregulated professions, vocations, or occupations; and
WHEREAS, it is imperative that individuals purporting to be experts in the management of rental property meet minimum educational standards and experience requirements prior to holding themselves out as rental property managers; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the Senate concurring, that the Auditor is respectfully requested to conduct a sunrise review of the rental property manager occupation, pursuant to section 26H-6, Hawaii Revised Statutes, as proposed to be regulated under H.B. No. (2011); and
BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations to the Legislature not later than twenty days prior to the convening of the Regular Session of 2012; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Director of Commerce and Consumer Affairs.
