A BILL FOR AN ACT

 

 

relating to historic preservation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-     Rezoning property on the national or state register of historic places.  Prior to the rezoning of any land, all or any portion of which is on the national or state register of historic places, the appropriate county council shall require the prior written concurrence of the board of land and natural resources, which concurrence shall be given only after consultation by the board with the state historic preservation division."

     SECTION 2.  This Act shall not apply to any zoning or rezoning action taken by any county prior to its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2011.
