A BILL FOR AN ACT

 

 

RELATING TO DEVELOPMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-      Highway development; developments.  (a)  As a condition precedent to the issuance of any grubbing, grading, excavation, or building permit for any portion or phase of a development, the county official responsible for issuing the permit shall certify that all conditional county and state highway improvements for the development have been completed or are under construction at the time of issuance of the permit.

     (b)  For the purposes of this section:

     "Conditional county and state highway improvement" means a county or state highway improvement that is a condition for the government's approval of a development.

     "Development" shall have the same meaning as in section 46-141."

     SECTION 2.  New statutory material is underscored.
     SECTION 3.  This Act shall take effect upon its approval.
