A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§321‑     Exemption from food preparation requirements; customary and traditional preparation of poi; rules.  (a)  Notwithstanding any other law to the contrary, including any rules adopted by the department of health based on the United States Food and Drug Administration Food Code 2009, the preparation of poi using customary and traditional Hawaiian cultural food preparation practices shall be exempt from regulation regarding food safety.

     (b)  The director of health shall adopt rules in accordance with chapter 91 to implement this section, including a list of:

     (1)  Valid customary and traditional Hawaiian cultural food preparation practices; and

     (2)  Methods of poi preparation;

that shall be exempt from regulation regarding food safety."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
