SENATE CONCURRENT
RESOLUTION
REQUESTING THE AUDITOR TO CONDUCT A SUNRISE REVIEW OF THE REGULATION OF LARGE-SCALE DOG BREEDERS AND DOG BREEDING FACILITIES.
WHEREAS, Senate Bill No. 1522, S.D. 2, H.D. 1 (2011), proposes to regulate large-scale dog breeders and dog breeding facilities, which are presently unregulated; and
WHEREAS, the Legislature finds that the State of Hawaii has no laws regulating the practices of large-scale dog breeders and dog breeding operations; and
WHEREAS, the Legislature also finds that because of the potential commercial gain from the breeding of dogs for use as household pets and the lack of laws regulating such practices, there is a possibility for inhumane treatment of animals in order to maximize profits; and
WHEREAS, inhumane practices may include crowding, insufficient food and water, insufficient space, or insufficient time allowed between breeding cycles; and
WHEREAS, Senate Bill No. 1522, S.D. 2, H.D. 1, in addition to prohibiting crowding, insufficient food and water, insufficient space, and insufficient time allowed between breeding cycles, would further require large-scale dog breeders to:
(1) Be licensed with the Department of Commerce and Consumer Affairs as a large-scale dog breeder;
(2) Document their breeding and caretaking practices; and
(3) Agree to allow unannounced inspections conducted by the Department of Commerce and Consumer Affairs or its agents or other law enforcement officers; and
WHEREAS, Senate Bill No. 1522, S.D. 2, H.D. 1, would provide important provisions for the prevention of animal cruelty; and
WHEREAS, section 26H-6, Hawaii Revised Statutes, requires the Auditor to review proposals to regulate professions, vocations, or occupations that are currently unregulated and to assess alternative forms of regulation; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the House of Representatives concurring, that the Auditor is respectfully requested to conduct a sunrise review of the regulation of large-scale dog breeders and dog breeding facilities, as proposed under Senate Bill No. 1522, S.D. 2, H.D. 1 (2011), including an assessment of alternative forms of regulation, pursuant to section 26H-6, Hawaii Revised Statutes; and
BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 2012; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Director of Commerce and Consumer Affairs.
