A BILL FOR AN ACT

 

 

RELATING TO CONSUMER INFORMATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  Chapter 328, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§328‑    Fresh bread; advertising.  Bread shall not be represented, advertised, labeled, or marketed using the term "fresh" or "fresh bread" unless the bread has never been frozen prior to retail sale to the consumer."

     SECTION 2.  Section 328-61, Hawaii Revised Statutes, is amended to read as follows:

     "§328-61  Notifying consumer.  No person shall sell or offer to sell any uncooked thawed food, including sliced, sandwich-style bread, which substantially resembles the physical appearances of the fresh food without a label[, as hereinafter described,] notifying the [purchaser] consumer that [such] the food had been frozen and then thawed out; provided that this section shall not apply if the thawed foods, except for sliced, sandwich-style bread, are processed by grinding or have been dehydrated before being offered for retail sale."

     SECTION 3.  Section 328-62, Hawaii Revised Statutes, is amended to read as follows:

     "§328-62  Description of label.  "Label" means the information required in this part to be placed on any food products, including sliced, sandwich-style bread, by means of a stamp, stencil, or printing by machine, or by attaching to the immediate package, by sign, handbill, placard, or otherwise, the words "PREVIOUSLY FROZEN" in letter size easily seen under customary conditions of purchase[.]; provided that in the case of previously frozen sliced, sandwich-style bread, the type size of the lettering shall be no less than twenty-four point font."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2050.

Description:

Requires sliced, sandwich-style bread products that have been baked and then frozen to be labeled "previously frozen".  Prohibits bread that has been frozen to be labeled or advertised as "fresh".  Effective 7/1/50.  (SD1)
