RELATING TO CABLE TELEVISION SYSTEMS. Allows the director of commerce and consumer affairs to designate access organizations to oversee public, educational, and governmental channels on cable television. (SD1)

RELATING TO THE HAWAII HURRICANE RELIEF FUND. Makes an appropriation from the Hawaii hurricane relief fund to restore the remaining public school instructional days for the 2009-2010 and 2010-2011 school years; provided that the moneys shall only be released upon completion of negotiations of parties necessary to execute the restoration of instructional days. Allocates a proportionate amount of the appropriation to charter schools. Requires unexpended funds from each school year to lapse to the Hawaii hurricane relief fund. (SD2)

RELATING TO CONDOMINIUMS. Requires that the developer set aside a percentage of the initial sales price of each residential apartment in a condominium project to be used to fund the project's estimated replacement reserve fund. Requires disclosure of the cost of capital equipment installed in the project. Requires that notice of amendments to project documents be provided to owners, purchasers, and potential purchasers and that amendments that effect a material change trigger a purchaser's right of rescission. RELATING TO PRIVATE GUARDS. Establishes licensure requirements, including training, instruction, and continuing education for guards and individuals acting in a guard capacity. Directs the board of private detectives and guards to make rules. (SD1)

RELATING TO COUNTIES. Provides that each county has the power to establish compassion centers for the dispensing of medical marijuana. Requires that compassion centers shall only provide service to qualified patients and primary caregivers registered with the department of public safety. Makes compassion centers subject to the general excise tax by making inapplicable the exemption for amounts received from sales of prescription drugs or prosthetic devices. Imposes a general excise tax on marijuana sales. Eff 8/7/2012. (SD1)

RELATING TO MORTGAGE LOAN ORIGINATORS. Exempts certain nonprofit organizations from chapter 454F, Hawaii Revised Statutes, relating to mortgage loan originators. Specifies that in a conflict between this Act and federal law, federal law shall prevail. (SD1)

RELATING TO MEDICAID REIMBURSEMENTS. Requires medicaid reimbursement to hospitals for patients occupying acute-licensed beds who are on a waitlist for long-term care to be at least equal to the rate paid for acute care services; requires medicaid reimbursement to long-term care facilities for patients with medically complex conditions to be at least equal to the rate paid for subacute care; appropriates funds for increased reimbursements. RELATING TO COUNTY ZONING FOR GROUP LIVING FACILITIES. Requires counties to consider in zoning for group living facilities impacts of traffic safety and congestion, elevated noise levels, and disruption of commercial deliveries upon the residents in the surrounding area.

RELATING TO WORKERS' COMPENSATION. Requires an employer who denies compensability, or indicates compensability is not accepted, to submit a written report to the director and claimant within thirty days of its denial of, or indication not to accept, compensability that substantiates its denial of compensability; prohibits the due date for the employer's written report to be extended. RELATING TO KANEOHE BAY REGIONAL COUNCIL. Clarifies that the department of land and natural resources shall not attend meetings nor provide administrative support for the Kaneohe Bay regional council; requires the Kaneohe Bay regional council to meet annually instead of quarterly and to report on its activities annually instead of semi-annually; repeals the sunset of the council scheduled for 7/1/2010; effective 6/30/50. RELATING TO EMPLOYMENT RELATIONS. Prohibits employers from discriminating against an employee or applicant for employment based upon the employee's or the applicant's domestic abuse victim status. (SD1)

RELATING TO THE HAWAII TOBACCO SETTLEMENT SPECIAL FUND. Deletes the requirement that the director of health convene an advisory group to plan the development and implementation of prevention programs and make recommendations on expenditures. Amends composition of the tobacco prevention and control advisory board and makes the boards decisions prescriptive. (SD2)

RELATING TO CONFORMITY OF THE HAWAII INCOME TAX LAW TO THE INTERNAL REVENUE CODE. Provides a measure for conforming amendments to the Hawaii income tax law based upon amendments to the Internal Revenue Code for calendar year 2009.

RELATING TO COST SHARING IN THE RELOCATION AND UNDERGROUNDING OF UTILITY FACILITIES. Allocates cost share among highway agencies and utilities for projects involving the removal, relocation, replacement, or reconstruction of utility facilities that border state or county highways. Clarifies federal funding share for cost of undergrounding utility facilities. Effective 7/1/50. (SD2)

RELATING TO EDUCATION. Protects the health, safety, and well-being of children following the occurrence of a situation that may have caused physical, psychological, or emotional harm to children during a school activity. Takes effect 7/1/2050. (SD1)

RELATING TO ELECTIONS. Changes the date of the primary election to the second Saturday of August for primary elections, including the OHA board. Changes the filing deadline for nomination papers to the first Tuesday in June, except for special primary or special elections. Effective 07/01/2050, shall apply to the primary elections held prior to the regularly scheduled general election held in November 2060, and every election thereafter. (SD2)

RELATING TO THE PERMITTED TRANSFERS IN TRUST ACT. Creates the Permitted Transfers in Trust Act to govern transfers of currency, bonds, and securities from a transferor to a trustee by means of an irrevocable trust instrument. Specifies that the rule against perpetuities does not apply to transfers pursuant to the Permitted Transfers in Trust Act. (SD2)

RELATING TO TRANSPORTATION ENERGY INITIATIVES. Requires that any parking facility with more than 99 parking spaces and fewer than 1,000 spaces designate 1 per cent of the spaces for electric vehicles by 12/31/2012; requires that any parking facility with 1,000 or more spaces designate 1 per cent of the spaces for green vehicles by 12/31/2012; requires that any parking facility with more than 99 spaces equip at least one electric vehicle space with an electric vehicle charging unit and be located near the building entrance; defines green vehicle to include hybrid vehicles with a fuel economy rating of 35 miles per gallon or higher for city driving; delays the authorization to issue fines to enforce electric and green vehicle parking from 7/1/2013 to 1/1/2014.
