RELATING TO STATE FINANCES. Amends the operating budget of the OHA and DHHL for fiscal years 2009-2010 and 2010-2011.

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS. Requires the State auditor to conduct a financial and management audit of the Office of Hawaiian Affairs, and to issue a report on or before the convening of the 2011 legislative session.

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS. Transfers the functions and duties of the historic preservation division of DLNR relating to Hawaiian burial sites to the Office of Hawaiian Affairs.

Transfers the functions and duties of the historic preservation division and the Kaho`olawe island reserve commission relating to Hawaiian burial sites to the Office of Hawaiian Affairs. Establishes special fund. Funds operation through conveyance tax revenues. Includes cave burials and burial sites.

RELATING TO ISLAND BURIAL COUNCILS. Authorizes the governor to waive the requirements that the Molokai island burial council membership include geographic region, development, and large property owner representatives.

RELATING TO MARINE LIFE CONSERVATION DISTRICTS. Requires that any conditions on permits issued for the taking of marine life or boating and coastal activities in marine life conservation districts shall be adopted pursuant to administrative procedures.

· By Web: Testimony may be submitted online if less than 4MB in size, at http://www.capitol.hawaii.gov/emailtestimony.
· In person: 1 copy of their testimony to the committee clerk, Room 228, State Capitol.
· By fax: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
Please note: If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign or foreign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
