RELATING TO AQUATIC RESOURCES. Exempts UH from permitting or application requirements when carrying out repair and maintenance relating to the Hawaii marine laboratory refuge. (SD1)

RELATING TO FISHING. Prohibits importation to the State or possession of shark fins unless the fins were taken from a shark landed whole in the State. Applies prohibition to any vessel stopping to refuel or offload cargo or otherwise in transit through waters of the State. Establishes presumption regarding possession of shark fins not attached to the carcass.

RELATING TO TAXATION. Imposes the general excise tax at the rate of 1.0% on the gross proceeds from the sale of real property less deductions for real estate salespersons' commissions and conveyance tax payments. Takes effect on 07/01/10 and sunsets on 06/30/15. Appropriates revenues for state programs and projects to accommodate land development and population growth resulting from land use plans and policies.

RELATING TO THE MAXIMUM TERM OF COMMERCIAL USE AND OPERATOR PERMITS FOR THRILL CRAFT AND PARASAILING. Removes the twenty-year limit for state parasailing permits.

RELATING TO THE PENAL CODE. Makes it a class C felony to assault a water safety officer who is engaged in the performance of duty.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
