MAKING APPROPRIATIONS TO PROVIDE FOR THE EXPENSES OF THE LEGISLATURE, THE AUDITOR, THE LEGISLATIVE REFERENCE BUREAU, AND THE OMBUDSMAN. Appropriates funds to provide for the expenses of the Legislature, Auditor, Legislative Reference Bureau, and Ombudsman. (HB2162 HD1)

RELATING TO BUDGETARY POWERS. Clarifies the budgetary powers of the legislature and the executive branches of government.

RELATING TO STATE BONDS. Authorizes issuance of general obligation bonds. Makes findings required by Article VII, Section 13 of the Hawaii Constitution to declare that issuance of authorized bonds will not cause debt limit to be exceeded.

RELATING TO SPECIAL FUNDS. Includes special funds in the auditor's review of revolving and trust funds.

RELATING TO FUNDS. Corrects a typographical error in the title of section 37-46, Hawaii Revised Statutes, relating to transfers of non-general funds to the general fund.

RELATING TO STATE FINANCES. Clarifies the role of the director of finance with respect to maintaining books and records.

RELATING TO NON-GENERAL FUNDS. Addresses the fiscal year 2009-2010 budget shortfall by transferring to the general fund a total of $10,000,000 in excess balances from certain special funds.

PROPOSING AN AMENDMENT TO ARTICLE VII, SECTION 6, OF THE HAWAII CONSTITUTION, RELATING TO THE TAX REBATE REQUIREMENT. Proposes a constitutional amendment to article VII, section 6 of the state constitution to authorize the legislature to determine whether excess funds should be used as tax refunds or tax credits to taxpayers of the state or diverted to the state's emergency and budget reserve fund.

RELATING TO STATE FUNDS. Clarifies that the 5-year limitation for short-term investments also applies to the underlying securities of those investments.

RELATING TO SPECIAL PURPOSE REVENUE BONDS. Requires an applicant for a special purpose revenue bond to apply for a pre-authorization certification from the department of budget and finance 3 months prior to the legislative session in which the applicant seeks the bond authorization. Sets out requirements for the pre-authorization certification for each type of bond.

When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
Please note: If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
