RELATING TO MOTOR CARRIERS. Allows commercial motor vehicles having a USDOT number for interstate transportation to enter the State's harbors to transport goods destined for interstate commerce.

RELATING TO COMMERCIAL DRIVER LICENSING. Conform sections 286-240(g) and (h), HRS to the federal commercial driver licensing law to meet the requirements of 49 CFR Section 383.51(e) before September 4, 2010, as required by Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU).

RELATING TO COMMERCIAL DRIVER LICENSING. Extend the term of a commercial driver's license (CDL) for persons 21 years through 71 years from six years to eight years to prepare for the REAL ID Act, which is a nationwide effort to improve the integrity and security of state-issued driver licenses and identification cards, to help fight terrorism and reduce fraud. Appropriate $8,000 out of the state highway fund.

RELATING TO SAFETY INSPECTION OF MOTOR CARRIER VEHICLES. Conform sections 286-207 and 286-209, HRS to be compatible to the Federal Motor Carrier Safety Regulations (FMCSR) and avoid any type of sanctions levied by the FMCSA.

RELATING TO DRIVER LICENSING. Differentiate category four motor vehicles from commercial motor vehicles to clarify that category four motor vehicles do not include commercial motor vehicles as defined in section 286-2, HRS.

RELATING TO TRANSPORTATION. Appropriates moneys from the highway development special fund to conduct a feasibility study to implement an intelligent transportation system on the island of Maui.

RELATING TO TRANSPORTATION. Requires the Department of Transportation to establish a public involvement process when developing the statewide transportation plan.

RELATING TO TRANSFER OF STATE HIGHWAYS. Creates a pilot project to transfer jurisdiction of state highways in Maui county from the state department of transportation to the Maui department of transportation.

RELATING TO PUBLIC HIGHWAYS. Prohibits vending on any scenic lookout, pull-off, or turnaround area of a public highway.

RELATING TO CRIME. Amends drivers license revocation provision to require a lifetime revocation when a driver is convicted of manslaughter involving the operation of a vehicle. Requires license revocation of five to ten years when a driver is convicted for negligent homicide in the first degree. Allows for up to two years of imprisonment when a convicted defendant is sentenced to probation for manslaughter.

RELATING TO FERRIES. Establishes the Hawaii state ferry system and the Hawaii state ferry system special fund for the operation of a ferry system between the islands.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
