Status

RELATING TO DRIVER LICENSING.

Makes the statutory requirements for provisional driver's licenses for persons under the age of eighteen permanent.

Status

RELATING TO ADMINISTRATIVE LICENSE REVOCATION.

Permits driver whose license has been administratively revoked for life to seek reinstatement of the license after 10 years have passed since the occurrence of the lifetime revocation.  Requires driver to have had no arrests or convictions for driving while license revoked and to be free from dependency or abuse of alcohol and drugs.  Effective 7/1/11.

Enacts the recommendations of the Ignition Interlock Implementation Task Force made pursuant to Act 171, Session Laws of Hawaii 2008.

RELATING TO OPERATING A VEHICLE WHILE INTOXICATED.

Requires the impoundment of the vehicle used by the defendant for highly intoxicated drivers and repeat offenders.  Institutes a one-year mandatory prison for offenders who have two prior convictions for DUI.  Requires alcohol treatment for repeat offenders.

Status

RELATING TO TRANSPORTATION.

Prohibits motorcycle, motor scooter, and moped mufflers from emitting a noise level above an unspecified decibel level.  Provides a graduated schedule of fines for first, second, and subsequent violations.

RELATING TO MOPEDS.

Requires mopeds to be inspected annually, to display a certificate of inspection, and to be operated only with an exhaust system that meets original manufacturer specifications.

Allows the use of sun screening materials that are applied to a certain portion of motor vehicle windshields and are in compliance with federal law.

RELATING TO MOBILE COMMUNICATIONS.

Makes it unlawful to use a mobile communication device while operating a vehicle with exceptions for emergency responders, two-way radios used for work-related purposes, and licensed radio operators.

RELATING TO MOTOR CARRIERS.

Repeals the exemption from the Motor Carrier Law for persons transporting garbage or refuse.

RELATING TO COST SHARING IN THE RELOCATION AND UNDERGROUNDING OF UTILITY FACILITIES.

Require any utility owners whose facility occupies State Highway right-of-way to provide their share of relocation costs up front to the affected state agency for encumbrance of funds in related contracts.

Status

RELATING TO TRANSPORTATION.

Establishes Pearl Harbor special fund into which shall be deposited impact fees collected from development in west Oahu to fund a feasibility study and planning for a Pearl Harbor underwater transportation tunnel.

·     Measure number; and

·     The number of copies the Committee is requesting.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
