RELATING TO THE WIRELESS ENHANCED 911 FUND. Requires an independent audit of the wireless enhanced 911 fund annually. Specifies that the audit shall include information on the status of projects undertaken or planned by public safety answering points. Specifies that the results of the audit shall be included in the board's annual report to the legislature.

RELATING TO FIREWORKS. Establishes a cause of action to abate the illegal purchasing, selling, possession, setting off, igniting or discharging of fireworks. Allows the court to order the closure of any place used in violation of the fireworks law. Allows for the forfeiture of property used in violation of the fireworks law.

RELATING TO SHERIFFS. Transfers the office of sheriff from the department of public safety to the department of the attorney general.

RELATING TO CRIME. Provides that patrons of prostitutes who are convicted of a first offense shall be required to pay a $500 surcharge and complete an 8-hour educational and counseling program. Establishes a special fund to fund and administer the program.

RELATING TO PUBLIC SAFETY. Requires the Hawaii paroling authority to establish a medical release program for no-risk inmates who are permanently and totally disabled, terminally ill, or geriatric. Requires department of public safety to assess and refer inmates to the Hawaii paroling authority. Sets conditions for medical release.

RELATING TO SENTENCING. Permits certain non-violent repeat offenders convicted of drug possession to be sentenced to alternative programs instead of to prison.

RELATING TO PUBLIC SAFETY. Requires bills to amend or create new offenses, or to change parole or probation procedures, to be accompanied by a correctional impact statement. Requires assistance of the corrections population management commission to prepare corrections population impact.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
