RELATING TO EMPLOYMENT SECURITY. Removes definitions requiring online posting of workers' availability and prohibiting all department of labor and industrial relations' rules, current and future, that require posting of workers' availability online.

RELATING TO WORKERS' COMPENSATION. Requires an employer who denies compensability, or indicates compensability is not accepted, to submit a written report to the director and claimant within thirty days of its denial of, or indication not to accept, compensability that substantiates its denial of compensability; prohibits the due date for the employer's written report to be extended. RELATING TO MEDICAL AND REHABILITATION BENEFITS. Clarifies that a physician or surgeon may conduct diagnostic testing or engage in a one-time consultation for a subspecialty diagnostic evaluation and treatment recommendations from a board certified or licensed specialist.

RELATING TO DISLOCATED WORKERS. Authorizes the department of labor and industrial relations to exercise enforcement powers against an employer in a covered establishment that would require the employer to adhere to, and comply with, the notification and penalty provisions of section 394B-9, HRS.

RELATING TO THE HAWAII CIVIL RIGHTS COMMISSION. Defines "confidential witness statement" and clarifies the allowable uses of factual matters obtained by the Hawaii civil rights commission during an investigation. (SD1)

RELATING TO THE HAWAII CIVIL RIGHTS COMMISSION. Extends the deadline for the Hawaii civil rights commission to adopt new rules regarding disability discrimination to allow for conformity with new federal rules. (SD1)

RELATING TO THE BOARD OF TRUSTEES OF THE DEFERRED COMPENSATION PLAN. Makes the director of human resources development one of two ex officio members and deletes the requirement to serve as the chairperson; requires the five public employee members to be elected by the employee-beneficiaries of the deferred compensation plan; deletes appointment by the governor and advice and consent of the senate; requires rules to be adopted.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:
PAPER: 4 copies (including an original) to Room 422 in the State Capitol;
FAX: For comments less than 5 pages in length, transmit to 586-6331 (Oahu) or 1-800-535-3859 (for Neighbor Islanders without a computer to submit testimony through e-mail or the Web); or
WEB: For comments less than 4MB in size, transmit from the Web page at http://www.capitol.hawaii.gov/emailtestimony.
Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
