Implements voting provisions for uniformed services and overseas absentee voters, as recommended by Federal Voting Assistance Program.

RELATING TO ELECTIONS.

Changes the date of the primary election to the second Saturday of August for primary elections, including the OHA board.  Changes the filing deadline for nomination papers to the first Tuesday in June, except for special primary or special elections.

RELATING TO OFFENSES AGAINST PUBLIC ORDER.

Amends the definition of "necessary sustenance" with regard to pet animals.  Adds a definition for "primary pet enclosure".

RELATING TO OFFENSES AGAINST PUBLIC ORDER.

Permits tethering of an unattended dog if the tether meets certain specifications and the dog is at least 6 months old.  Establishes mandatory fines.

RELATING TO DESECRATION.

Provide that a person may be convicted of the offense of desecration for negligently desecrating a place of burial, rather than requiring an intentional act.

RELATING TO DANGEROUS INSTRUMENTS.

Expands scope of offenses of terroristic threatening in the first degree and robbery in the first degree to include the use of a replica firearm.

RELATING TO DOMESTIC ABUSE ORDERS.

Allows a temporary restraining order to remain in effect for 90 days or until service of a protective order, whichever occurs first.  Also amends law to provide that protective orders orally stated by the court on the record shall be effective upon service on the respondent.

·         By Web: Testimony may be submitted online if less than 4MB in size, at http://www.capitol.hawaii.gov/emailtestimony.

 

·         In person:  1 copy of their testimony to the committee clerk, Room 219, State Capitol.

 

·         By fax:  Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing.  When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.

 

Please note:  If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally.  A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing. 

 

If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign or foreign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
