RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND. Adds three new sections on selection of benefit plan carriers, fiduciary duties, and liability for breach of fiduciary duty; exempts the Hawaii employer-union health benefits trust fund from the requirement to use the attorney general; increases the members of the board of trustees from ten to twelve and changes membership and terms; authorizes the board to retain an attorney who is independent of the attorney general as legal advisor; transfers the fund from the department of budget and finance to the department of human resources development. Requires biennial reports to the legislature. Sunsets on July 1, 2015.

RELATING TO THE EMPLOYER-UNION HEALTH BENEFITS TRUST FUND. Requires one trustee of the employer-union health benefits trust fund to be occupied by a representative appointed by the Hawaii council of mayors to represent county interests. Effective upon approval.

MAKING AN APPROPRIATION FOR COLLECTIVE BARGAINING COST ITEMS. Provides employer contribution amounts for Hawaii Employer-Union Health Benefits Trust Fund health benefit plan premiums in plan years 2009-2010 and 2010-2011 for employees of collective bargaining units (1) and (10) and their excluded counterparts. Effective upon its approval.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
