RELATING TO THE HAWAII HURRICANE RELIEF FUND. Makes an appropriation from the Hawaii hurricane relief fund to restore the remaining public school instructional days for the 2009-2010 and 2010-2011 school years; provided that the moneys shall only be released upon completion of negotiations of parties necessary to execute the restoration of instructional days. Allocates a proportionate amount of the appropriation to charter schools. Requires unexpended funds from each school year to lapse to the Hawaii hurricane relief fund.

RELATING TO EDUCATION. Clarifies the law for determining school impact fees for financing new or the expansion of existing Department of Education educational facilities. Effective upon its approval.

RELATING TO EARLY EDUCATION. Requires the Department of Education and Early Learning Council to work together on the development and submission of a plan to the Legislature for the integration of the cohort of children who would otherwise attend junior kindergarten into the early learning system.

RELATING TO CHARTER SCHOOLS. Requires the Department of Education (DOE) to consider making available vacant school facilities or portions of those facilities for use by charter schools. Requires the Charter School Review Panel to compile and submit to DOE a prioritized list of charter schools that wish to use these facilities. Effective July 1, 2050.

RELATING TO THE BOARDS OF WATER SUPPLY. Authorizes a county board of water supply to delegate its power relating to the disbursement of funds to its manager and chief engineer.

RELATING TO CONVEYANCE TAX. Requires the director of taxation to provide the administrator of each county's real property assessment division with an image of all certificates of conveyances filed with the bureau of conveyances.

RELATING TO CONSERVATION AND RESOURCES ENFORCEMENT PROGRAM. Establishes the Conservation and Resources Enforcement Special Fund administered by the Department of Land and Natural Resources to enforce natural, cultural, and historic resources protection laws and rules.

RELATING TO AGRICULTURE. Provides for fair compensation when leased public land for agricultural or pastoral uses is withdrawn, condemned, or taken for public purposes. Establishes the Agricultural Inspection and Certification Special Fund, to be used for the inspection and certification of agricultural commodities.

RELATING TO THE MAXIMUM TERM OF COMMERCIAL USE AND OPERATOR PERMITS FOR THRILL CRAFT AND PARASAILING. Removes the twenty-year limit for state parasailing and thrill craft permits, and makes those permits renewable annually. Directs DLNR to offer for public auction permits that have been revoked for cause. Effective July 1, 2010.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
