RELATING TO EMPLOYMENT SECURITY. Proposed HD1: Requires the Department of Labor and Industrial Relations to conduct a study on the cost and feasibility of changing from annual to semi-annual the contribution rate schedules for unemployment contributions. Provides for fixed reserve ratios for calendar years 2010 and 2011 for employers commencing operations in 2010 and employers currently in operation who hire new employees or rehire employees that were laid-off prior to January 1, 2010. Requires the department of labor and industrial relations to review the auditor's study conducted in 1982 regarding the financing mechanisms of the unemployment compensation fund. Requires reports.

RELATING TO UNEMPLOYMENT INSURANCE BENEFITS. Authorizes an individual that is attached to a regular employer who is not offering work to still receive unemployment insurance benefits even if that individual voluntarily or involuntarily separates from part-time employment, with or without good cause.

RELATING TO SALARIES. Increases the salary reduction for the governor, the lieutenant governor, the justices and judges of all state courts, the administrative director of the State or an equivalent position, the department heads or executive officers and the deputies or assistants of various state departments, and legislators from 5% to 8.07% for the second half of the 2009-2010 fiscal biennium.

RELATING TO SALARY AND PENSION PAYMENTS. Requires all employees hired prior to July 1, 1998, and who have not designated a financial account into which the State is authorized to deposit the employee's pay, to designate an account no later than a date to be determined.

RELATING TO MEDICAL AND REHABILITATION BENEFITS. Clarifies that a physician or surgeon may conduct diagnostic testing or engage in a one-time consultation for a subspecialty diagnostic evaluation and treatment recommendations from a board certified or licensed specialist.

RELATING TO EMPLOYMENT PRACTICES. Makes it an unlawful practice for any employer or labor organization to bar or discharge from employment, withhold pay from, or demote an employee because the employee legitimately uses accrued and available negotiated sick leave in accordance with an employer's attendant and negotiated sick leave policies, except for abuse of sick leave. Provides exceptions for essential job functions or requirements. Effective December 21, 2058.
