RELATING TO LIQUOR COMMISSIONS.

Requires county liquor commissions to adopt or amend rules regarding conduct of patrons and to define the term "dancing."

RELATING TO ENVIRONMENTAL PROTECTION.

Requires businesses in the State to collect an offset fee for each plastic disposable checkout bag distributed to customers.

RELATING TO THE KAHO‘OLAWE ISLAND RESERVE COMMISSION.

Exempts contracts made by the Kaho‘olawe island reserve commission for the procurement of food or fuel products from the state procurement code.

RELATING TO PERMIT, LICENSE, AND APPROVAL APPLICATION PROCESSING.

Establishes a maximum time period that an application for permit, license, or approval shall be deemed granted if not acted upon by the designated agency; authorizes each county to contract with a third-party reviewer to streamline the processing of applications; clarifies that previously approved projects that do not impact historic properties are not subject to subsequent reviews by the SHPD.

RELATING TO THE NATURAL ENERGY LABORATORY OF HAWAII AUTHORITY.

Authorizes natural energy laboratory of Hawaii to acquire, hold, and sell qualified securities subject to certain conditions.  Authorizes NELHA to accept donations of money and services.

RELATING TO PUBLIC PROCUREMENT.

Requires a purchasing agency to hold a pre-bid conference. Requires parties that protest a contract award to have attended a pre-bid conference.

RELATING TO PUBLIC PROPERTY.

Amends definition of the term "concession" to remove telecommunications operations.  Exempts telecommunications operations from the Hawaii public procurement code.

Amends the Hawaii public procurement code to make public contracts effective as of the notice of the award.  Specifies that the solicitation, offer, bid, or proposal and the award notice constitute the entire contract.  Provides that a subsequent written and executed contract is not required.

Establishes special procedures for requests for competitive sealed proposals for design-build projects.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

·     Testifier's name with position/title and organization;

·     The Committee the comments are directed to;

·     The date and time of the hearing;

·     Measure number; and

·     The number of copies the Committee is requesting. 

 

While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
