RELATING TO INSURANCE CLAIMS ADJUSTERS. Allows a claims adjuster to take an examination approved by the Risk Management Agency of the United States Department of Agriculture in order to qualify for a limited insurance adjuster's license.

RELATING TO NEGOTIABLE INSTRUMENTS. Removes limitations pertaining to reasonableness for service charges relating to dishonored checks.

RELATING TO REAL PROPERTY. Extends repeal date of Act 189, SLH 2009, to 6/30/2010.

RELATING TO MOTOR VEHICLES. Establishes criminal penalties for fraudulent installation or reinstallation of an airbag. Requires that any person engaged in the business of purchasing, selling, or installing an airbag maintain detailed records of airbags they purchase, sell, or install. Mandates that any person engaged in the business of installing an airbag submit an affidavit to a vehicle owner saying that an airbag was installed properly. Requires a person repairing a vehicle to affix a permanent dashboard label disclosing that a salvaged airbag had been used. Establishes that police accident reports must note whether an airbag deployed. Requires that a person trading or selling a motor vehicle must disclose whether an airbag is inoperable.

RELATING TO USED MOTOR VEHICLE SALES. Requires dealers to disclose material facts, as well as material mechanical defects, to consumers of used motor vehicles. Requires dealers to use good faith and due care in preparing disclosure notice to consumers of used motor vehicles.

RELATING TO CONDOMINIUMS. Requires that the developer collect a percentage of the initial sales price of each residential apartment in a condominium project to be used to fund the project's estimated replacement reserve fund. Requires that notice of amendments to project documents be provided to owners, purchasers, and potential purchasers.

RELATING TO PRIVATE GUARDS. Establishes training, instruction, and continuing education requirements for guards and individuals acting in a guard capacity. Directs the board of private detectives and guard to make rules.

· In person: 1 copy of their testimony to the committee clerk, Room 231, State Capitol.
· By fax: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
Please note: If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign or foreign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
