SENATE CONCURRENT
RESOLUTION
requesting the auditor to conduct a sunrise review of the regulation of real estate appraisal management companies.
WHEREAS, Senate Concurrent Resolution No. 53 (S.C.R. No. 53) was passed by both the Senate and the House of Representatives in the Regular Session of 2009; and
WHEREAS, S.C.R. No. 53 requested that the Auditor conduct a sunrise review of real estate appraisal management companies and assess whether the enactment of the regulatory measure contained in S.B. No. 1606, introduced in the Regular Session of 2009, is consistent with the policies set forth in section 26H-6, Hawaii Revised Statutes; and
WHEREAS, S.C.R. No. 53 requested that the Auditor report any findings and recommendations, including an assessment of alternate regulatory enforcement frameworks other than the one contained in S.B. No. 1606, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2010; and
WHEREAS, the Auditor has not released a sunrise review of real estate appraisal management companies and assessment of whether the regulatory measure contained in S.B. No.1606 is consistent with the policies set forth in section 26H-6, Hawaii Revised Statutes; and
WHEREAS, real estate appraisal management companies continue to be unregulated by any state or federal agencies; and
WHEREAS, the continued unavailability of the Auditor's report impedes the Legislature in the exercise of its constitutional function by delaying the enactment of legislation to regulate the real estate appraisal industry; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the House of Representatives concurring, that the Auditor is requested to perform the sunrise review of real estate appraisal management companies and assessment of whether the enactment of the regulatory measure contained in S.B. No. 1606 is consistent with the policies set forth in section 26H-6 that was originally requested in S.C.R. No. 53; and
BE IT FURTHER RESOLVED that the Auditor is further requested to report any findings and recommendations, including an assessment of alternate regulatory enforcement frameworks other than the one contained in S.B. No. 1606, to the Legislature no later than thirty days after the passage of this Concurrent Resolution; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Director of Commerce and Consumer Affairs.
