A BILL FOR AN ACT
relating to public safety.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 353C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§353C- Critical incident planning and mapping system; established. (a) There shall be established by the department a critical incident planning and mapping system to provide information, standards, guidelines, and protocols to first responders and other responding state agencies to help them respond appropriately and efficiently to criminal or terroristic acts, or related emergencies, occurring in any public school in this State.
(b) The critical incident planning and mapping system shall at a minimum consist of the following:
(1) A computer software program that includes floor plans, fire protection information, building evacuation plans, utility information, information regarding known hazards, and information on how to contact emergency personnel for every public school in this State;
(2) The preferred manner on how to assimilate and disperse the critical incident planning and mapping system information from the state agencies and the political subdivisions that participate in the critical incident planning and mapping system;
(3) Guidelines, standards, and a uniform protocol for the state agencies and political subdivisions that subscribe to using the information from the critical incident planning and mapping system software;
(4) Conditions for using the critical incident planning and mapping system by first responders and other responding state agencies;
(5) Standards for ensuring confidentiality of facility information and providing widespread access to the information contained in the critical incident planning and mapping system; and
(6) Guidelines for the training of persons employed by first responders and other responding state agencies concerning the use of the critical incident planning and mapping system.
(c) To the extent money is made available, the state agencies and political subdivisions shall:
(1) Participate in the critical incident planning and mapping system; and
(2) Incorporate into their use of the critical incident planning and mapping system, without limitation:
(A) Evacuation routes and strategies for evacuation;
(B) Alarms and other signals or means of notification;
(C) Plans for sheltering in place; and
(D) Training and strategies for prevention in connection with attacks involving violence.
If a state agency or a political subdivision has its own planning and mapping system prior to the establishment of a statewide critical incident planning and mapping system under this chapter, the state agency or political subdivision may continue to use its own system, unless funds are made available for that state agency or political subdivision to update or modify its own system as necessary for inclusion in the statewide critical incident planning and mapping system.
(d) The department of public safety shall:
(1) Pursue any funding that may be available from the federal government for the development and operation of a statewide critical incident planning and mapping system for public schools in this State and for the distribution of grants to the state agencies and political subdivisions that participate in the critical incident planning and mapping system; and
(2) Pursue monetary gifts, grants, and contributions for the development and operation of a statewide critical incident planning and mapping system and for the distribution of grants to the state agencies and political subdivisions that participate in the critical incident planning and mapping system.
(e) Each state agency and political subdivision that participates in the critical incident planning and mapping system shall, on or before July 1, 2010, and on or before July 1 of each year thereafter, submit to the department a progress report setting forth, in accordance with rules adopted by the department, the experience of the agency or political subdivision, as applicable, with respect to its participation in the critical incident planning and mapping system. The department shall summarize the progress reports and submit a report to the legislature no later than twenty days prior to the convening of the 2011 regular session, and each regular session thereafter.
(f) After the statewide critical incident planning and mapping system is established pursuant to this chapter, each state agency and political subdivision that participates in the critical incident planning and mapping system shall submit to the department the information required under subsection (b)(1), including any initial or final plan that constructs, modifies, or substantially alters any of the structures or infrastructure of a public school in this State.
(g) For the purposes of this section, "sheltering in place" means to remain inside a building, room, structure, or other location during an emergency when egress may be impossible or when egress may present a more substantial risk than remaining inside the building, room, structure, or other location."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
