A BILL FOR AN ACT

RELATING TO LOW-FLUSH TOILET.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-   Low flush toilets; mandatory installation. (a)  Effective July 1, 2010, every county building code shall require that all toilets installed in new residential or commercial buildings are low-flush toilets.  For the purposes of this section, "low-flush toilet" means a toilet that consumes no more than       gallons of water per flush.

(b)  Nothing in this section shall preclude any county from establishing procedures and standards required to implement this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2010.
