A BILL FOR AN ACT

 

 

relating to sexual OFFENSEs.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 706, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§706-     Sexual offenses involving minors; enhanced sentencing.  Notwithstanding any other law to the contrary, whenever a person is found guilty of any sexual offense that is punishable as a felony under part V of chapter 707 and the victim is less than eighteen years of age, the conviction shall carry a mandatory minimum term of imprisonment of not less than six months."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
