A BILL FOR AN ACT
RELATING TO the STATEWIDE TRAFFIC CODE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§291C‑ Driving in right lane. (a) A truck, tractor‑semitrailer combination, trailer, truck-tractor, or truck-trailer combination, as those terms are defined in section 286‑2, but not including a pickup truck, shall be driven on the publicly maintained right lane of a highway and those private streets as described in section 46-16, having two or more lanes in the same direction with a posted speed limit equal to or greater than forty-five miles per hour.
(b) This section shall not apply to a driver who is:
(1) Preparing for a left-hand turn;
(2) Yielding to an emergency vehicle;
(3) Moving around a stalled vehicle or other obstacle in the right lane; or
(4) Overtaking and passing another vehicle proceeding in the same right lane.
(c) The penalty for violation of this section shall be as provided in section 291C-161."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
