A BILL FOR AN ACT
RELATING TO EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The department of education is one of the largest and most complex of the state departments. The department of education comprises the board of education, office of the superintendent of education, public school system, and public library system. The public school system includes the office of school facilities and support services; office of curriculum, instruction and student support; office of fiscal services; office of human resources; office of information technology services; and administrative district offices for seven school complexes composed of Honolulu, Central Oahu, Leeward Oahu, Windward Oahu, Hawaii, Maui, and Kauai. In addition, there is the advisory council for Hawaii state adult and community education, library advisory commissions, teacher education coordinating committee, educational officer classification/compensation appeals board, and Hawaii teacher standards board.
The legislature finds that the auditor has not conducted an audit of the comprehensive management system of the department of education. Issues have arisen as to whether the so-called comprehensive management system has fully implemented fundamental management controls to ensure efficiency in leadership, responsibility, and accountability. The department of education should be:
(1) Using best practices to improve educational systems management throughout the department divisions;
(2) Implementing sound recommendations that would improve daily departmental operations;
(3) Monitoring latest developments in educational policies;
(4) Implementing internal and external controls regarding compliance with federal and state law; and
(5) Improving management and administrative operations.
The legislature finds that the department of education could benefit from having more consistent and systematic oversight of middle-management in the performance of the department's tasks. An audit is necessary for the purpose of analyzing and critiquing management practices of the department of education.
The purpose of this Act is to direct the auditor to conduct a management audit of mid-level management of the department of education.
SECTION 2. The auditor is directed to conduct a management audit of mid-level management of the department of education.
SECTION 3. The auditor is directed to report findings and recommendations to the legislature no later than twenty days prior to the convening of the regular session of 2011.
SECTION 4. This Act shall take effect upon its approval.
