A BILL FOR AN ACT

 

 

relating to insurance coverage for mammograms.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to article 10A to be appropriately designated and to read as follows:

     "§431:10A-    Mammograms; referral not required.  No insurer shall require a covered person over the age of forty to obtain a referral from a primary care provider or other physician for an annual mammogram.  An insurer shall provide full coverage for one mammogram per year obtained pursuant to this section."

     SECTION 2.  Chapter 432, Hawaii Revised Statutes, is amended by adding a new section to article 1 to be appropriately designated and to read as follows:

     "§432:1-    Mammograms; referral not required.  No mutual benefit society shall require a covered person over the age of forty to obtain a referral from a primary care provider or other physician for an annual mammogram.  A mutual benefit society shall provide full coverage for one mammogram per year obtained pursuant to this section."

     SECTION 3.  Chapter 432, Hawaii Revised Statutes, is amended by adding a new section to article 2 to be appropriately designated and to read as follows:

     "§432:2-    Mammograms; referral not required.  No fraternal benefit society shall require a covered person over the age of forty to obtain a referral from a primary care provider or other physician for an annual mammogram.  A fraternal benefit society shall provide full coverage for one mammogram per year obtained pursuant to this section."

     SECTION 4.  Chapter 432D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§432D-    Mammograms; referral not required.  No health maintenance organization shall require a covered person over the age of forty to obtain a referral from a primary care provider or other physician for an annual mammogram.  A health maintenance organization shall provide full coverage for one mammogram per year obtained pursuant to this section."

     SECTION 5.  New statutory material is underscored.


     SECTION 6.  This Act shall take effect on July 1, 2010.
