A BILL FOR AN ACT
RELATING TO LONG TERM CARE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The long term care commission, established by Act 224, Session Laws of Hawaii 2008, has reported that it is unable to meet its reporting deadlines to the legislature of February 28, 2010, and September 30, 2010, due to a lack of funding. The long term care commission is set to expire on November 30, 2010. Delays in obtaining the funds necessary to support the work of the commission made it impossible to meet the reporting dates specified in Act 224. In time, funding from non-state sources was secured and a work plan was adopted by the commission, but with new interim and final reporting dates. The commission believes the interim report called for by Act 224 can be timely submitted to the 2011 legislature, and the final report called for by Act 224 can be timely submitted to the 2012 legislature.
The purpose of this Act is to extend the sunset of the long term care commission and its reporting deadlines to the legislature.
SECTION 2. Act 224, Session Laws of Hawaii 2008, is amended by amending section 4 as follows:
1. By amending subsection (g) to read:
"(g) The long term care commission shall:
(1) Submit an interim report to the legislature no
later than [February 28, 2010,] January 19, 2011, describing the
progress made in the development of the five-year plan and preliminary proposed
system reforms; and
(2) Submit a final report to the legislature no later
than [September 30, 2010,] January 18, 2012, which shall include
the final five-year plan, how the reforms will be prioritized and phased in,
and a description and final recommendations regarding the financing of long
term care services, including support for caregivers."
2. By amending subsection (j) to read:
"(j) The term of the long term care
commission shall expire on [November 30, 2010.] June 30, 2012."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
