A BILL FOR AN ACT
relating to procurement.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 103D, Hawaii Revised Statutes, is amended by adding two new sections to part IV to be appropriately designated and to read as follows:
"§103D- Fluorescent light bulbs. Notwithstanding section 196-23, the procurement policy for all agencies that purchase light bulbs for use in any building, site, or facility owned by the State or any county or maintained by or on behalf of the State or any county shall be to purchase and use only ENERGY STAR qualified fluorescent light bulbs for all interior and exterior lighting. Items purchased pursuant to this section shall not be subject to life cycle cost analysis pursuant to section 196-19.
§103D- Biodegradable and recyclable supplies. (a) The procurement policy for all agencies that purchase office supplies for use in any building, site, or facility owned by the State or any county or maintained by or on behalf of the State or any county shall be to purchase and use only biodegradable or recyclable office supplies when biodegradable or recyclable office supplies are available. Items purchased pursuant to this section shall not be subject to life cycle cost analysis pursuant to section 196-19.
(b) For the purposes of this section, office supplies shall include disposable or consumable products such as paper towels, paper napkins, dining supplies, hand soap, and cleaning supplies intended for use by individuals who work at the building, site, or facility."
SECTION 2. Section 103D-104, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:
""ENERGY STAR qualified" means a product that meets energy efficiency criteria set by the United States Environmental Protection Agency or the United States Department of Energy as determined by those agencies."
SECTION 3. Section 103D-412, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:
"(b) Beginning January 1, 2010, all state and
county entities, when purchasing new vehicles, shall [seek] purchase
vehicles with reduced dependence on petroleum-based fuels that meet the needs
of the agency. Beginning July 1, 2010, all vehicles purchased pursuant to
this subsection shall have a fuel efficiency rating of no less than forty miles
per gallon for cars and thirty miles per gallon for trucks and other vehicles.
Priority for selecting vehicles shall be as follows:
(1) Electric or plug-in hybrid electric vehicles;
(2) Hydrogen or fuel cell vehicles;
(3) Other alternative fuel vehicles;
(4) Hybrid electric vehicles; and
(5) Vehicles that are identified by the United States Environmental Protection Agency in its annual "Fuel Economy Leaders" report as being among the top performers for fuel economy in their class."
SECTION 4. The requirements in section 1 of this Act shall apply to all light bulbs and office supplies purchased after the effective date of this Act.
SECTION 5. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2010.
