A BILL FOR AN ACT

 

 

RELATING TO ADMINISTRATIVE REVOCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 291E-38, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The hearing shall be held at a place designated by the director, as close to the location where the notice of administrative revocation was issued as [practical.] practicable; provided that the director may authorize a hearing to be held with the consent of the respondent:

     (1)  In a county other than the county in which the notice of administrative revocation was issued; or

     (2)  By video."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on December 21, 2058; provided that on January 1, 2012, this Act shall be repealed and section 291E-38, Hawaii Revised Statutes, shall be reenacted in the form in which it read on the day before the effective date of this Act.
