HOUSE CONCURRENT
RESOLUTION
urging the department of health to develop a voucher system for the collection of used tires to address illegal dumping.
WHEREAS, it is estimated that 500,000 to 1,000,000 waste tires are generated in Hawaii each year; and
WHEREAS, many of those used tires end up on the side of roads and in illegal dumps, spoiling the natural beauty of the islands; and
WHEREAS, abandoned scrap tire stockpiles cause environmental damage, including causing fires, creating potential for mosquito breeding grounds, and contaminating the air, water, and soil; and
WHEREAS, the state Used Motor Vehicle Tire Recovery law regulates the disposal of used tires by:
(1) Prohibiting the placement of whole motor vehicle tires in mixed municipal solid waste;
(2) Prohibiting the disposal of motor vehicle tires except by delivery to a motor vehicle tire retailer, tire wholesaler, or an authorized tire collection or authorized tire recycler;
(3) Requiring tire retailers to accept used tires from customers buying new tires;
(4) Requiring tire wholesalers to collect used tires from the retailer within 90 days;
(5) Limiting the accumulation of used tires by the retailer to 250 tires; and
(6) Requiring that the tires be stored in a manner consistent with fire prevention and vector control;
and
WHEREAS, there are few tire recycling facilities in the state, making it difficult for tire retailers and wholesalers to comply with these requirements; and
WHEREAS, there are reports that some tire collection services are not carrying out their responsibilities to properly deliver used tires they have collected from tire retailers and wholesalers for a fee, to the tire recycling facilities, and the tires are instead found in illegal dump sites, particularly on the Waianae Coast; and
WHEREAS, the implementation of a used tire collection system that requires a tire collection service to deliver the used tires to the recycling facility before the tire collection receives payment, would improve this situation; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the Senate concurring, that the Department of Health is urged to develop and implement a voucher system for tire collection services whereby the tire collection service is required to deliver the used tires to the recycling facility before the tire collection service may receive payment; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Health, President of Maui Tire Recycling, LLC, and President of Unitek Solvent Services, Inc.
